The Surrogacy Medicolegal Issues depicts the judicial pronouncements of eminent jurists around the globe in relation to surrogacy and portrays the new definition as to what now constitutes a family. Surrogacy is a contractual undertaking whereby the natural or the surrogate mother, for a fee agrees to conceive a child through artificial insemination with the sperm of the natural father, and to terminate all of her parental rights subsequent to the birth of the child. Surrogacy is a new challenge faced among infertile married couples, single males and foreigners traveling to India other than Overseas Citizenship of India (OCI), Person of Indian Origin (PIO) and Non-resident Indian (NRI) couples in search of a child to call their own and foster parenthood. The rules relating to surrogacy in India, universal formation of laws regarding issue of surrogacy, and the legal loopholes which need to be plugged for good are the major topics of discussion.
